Who we are

Fortivus ("we," "us," or "our") is a care navigation platform operated by Tall Pine Land Investments, LLC, doing business as Fortivus. This Privacy Policy describes how we collect, use, and protect information when you use our website and platform at fortivuscares.com.

Information we collect

We collect information you provide directly to us, including:

  • Contact information — name, email address, and any other details you provide when joining the waitlist or contacting us
  • Account information — when you create an account, including login credentials
  • Care-related information — documents, notes, and details you upload or enter about your family's caregiving situation
  • Communications — messages you send us, survey responses, or feedback you provide

We also collect certain information automatically when you use our service, including device information, IP address, browser type, pages visited, and usage patterns. We use this information to improve the platform and understand how it's being used.

How we use your information

We use the information we collect to:

  • Provide, maintain, and improve the Fortivus platform
  • Personalize Sage's guidance based on your specific family situation
  • Send you product updates, waitlist communications, and information you've requested
  • Respond to your questions and provide support
  • Monitor and analyze usage patterns to improve our service
  • Comply with legal obligations
We do not sell your personal information. We do not share your information with third parties for their marketing purposes. We do not use your care-related information for advertising.

How we protect your information

We take the security of your information seriously. Fortivus is built on HIPAA-compliant infrastructure. We use industry-standard encryption for data in transit and at rest. Access to personal information within our organization is limited to personnel who need it to provide the service.

No system is completely secure, and we cannot guarantee the absolute security of your information. We encourage you to use a strong, unique password and to contact us immediately if you believe your account has been compromised.

Data retention

We retain your information for as long as your account is active or as needed to provide our service. If you close your account, we will delete or anonymize your personal information within 90 days, except where we are required to retain it for legal or compliance purposes.

Your rights

You have the right to access, correct, or delete the personal information we hold about you. You may also request that we restrict our processing of your information or object to certain uses. To exercise these rights, contact us at the address below.

Cookies

We use cookies and similar tracking technologies to operate and improve our platform. You can control cookies through your browser settings. Disabling certain cookies may affect the functionality of the platform.

Children's privacy

Fortivus is not directed at children under the age of 18. We do not knowingly collect personal information from anyone under 18. If you believe we have inadvertently collected such information, please contact us immediately.

We may update this Privacy Policy from time to time. We will notify you of material changes by email or through a notice on our platform. Your continued use of the service after changes take effect constitutes acceptance of the updated policy.

Terms of Service

Acceptance of terms

By accessing or using Fortivus, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our service. These terms apply to all users of the platform, including visitors, waitlist members, and account holders.

What Fortivus is — and is not

Important: Fortivus is a care navigation and organizational platform. It is not a licensed medical provider, attorney, financial advisor, or healthcare facility. The information and guidance provided through Fortivus, including guidance from Sage, is for organizational and informational purposes only and does not constitute medical advice, legal advice, financial advice, or professional caregiving services.

Always consult a qualified physician, attorney, financial advisor, or other licensed professional before making medical, legal, or financial decisions. Fortivus is designed to help you organize information and prepare for those conversations — not to replace them.

Your account

You are responsible for maintaining the security of your account and password. You agree to notify us immediately of any unauthorized use of your account. You are responsible for all activity that occurs under your account.

You must be at least 18 years old to create an account. By creating an account, you represent that you meet this requirement.

Your content

You retain ownership of all documents, notes, and information you upload to Fortivus. By uploading content, you grant us a limited license to store, process, and display that content solely for the purpose of providing the service to you. We do not claim ownership of your content.

You are responsible for ensuring you have the right to upload any content you add to the platform, including documents belonging to or relating to other individuals.

Acceptable use

You agree not to use Fortivus to:

  • Violate any applicable law or regulation
  • Upload content you do not have the right to share
  • Attempt to gain unauthorized access to the platform or other users' accounts
  • Interfere with the proper functioning of the service
  • Use the platform for any commercial purpose without our written consent

Shared access

Fortivus allows you to share access to your account with other family members. You are responsible for ensuring that anyone you grant access to understands and agrees to these Terms of Service. You control what information is shared and with whom.

Service availability

We aim to make Fortivus available at all times, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue the service at any time with reasonable notice.

Limitation of liability

To the maximum extent permitted by law, Fortivus and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the service. Our total liability to you for any claim arising from your use of the service shall not exceed the amount you paid us in the twelve months preceding the claim.

Governing law

These terms are governed by the laws of the State of Idaho, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of Ada County, Idaho.

Changes to these terms

We may update these Terms of Service. We will provide at least 30 days' notice of material changes. Your continued use of the service after changes take effect constitutes acceptance.

HIPAA Notice

HIPAA Notice of Privacy Practices

Note on HIPAA applicability: Fortivus is a care coordination tool used by family caregivers — not a covered healthcare provider, health plan, or healthcare clearinghouse under HIPAA. As such, Fortivus is not directly a "covered entity" under HIPAA. However, we have chosen to build our infrastructure to HIPAA-compliant standards and adopt HIPAA-aligned privacy practices because we believe families entrusting us with health-related information deserve that level of protection. This notice explains those practices.

Our commitment to your health information

Fortivus handles information that may include protected health information (PHI) — medical records, diagnoses, medication lists, and other health-related documents that you upload about your family members. We treat all of this information with the highest level of care and confidentiality.

How we use health-related information

We use health-related information you provide solely to:

  • Provide the Fortivus platform and Sage's guidance to you
  • Generate organizational summaries, alerts, and prioritized action plans based on your situation
  • Improve our platform's ability to serve caregiving families (using de-identified, aggregated data only)

We do not use health-related information for advertising, marketing, or sale to third parties — ever.

With whom we share health-related information

We do not share identifiable health-related information with third parties except:

  • Service providers — technology vendors who help us operate the platform (such as cloud infrastructure providers) under strict data processing agreements
  • Legal requirements — when required by law, court order, or government authority
  • Safety — when necessary to prevent serious harm to you or others
  • With your consent — when you explicitly authorize sharing with a specific third party

Your rights regarding your health information

You have the right to:

  • Access and download all health-related information you have provided to Fortivus
  • Correct inaccurate information
  • Request deletion of your health information
  • Revoke access you have granted to other family members at any time
  • Receive a copy of this notice in a format accessible to you

Security safeguards

Fortivus is built on HIPAA-compliant infrastructure, including encrypted data storage, encrypted data transmission, multi-factor authentication, role-based access controls, and audit logging. We have executed Business Associate Agreements (BAAs) with our infrastructure providers where applicable.

Breach notification

In the unlikely event of a data breach involving your health information, we will notify you promptly in accordance with applicable law, and no later than 60 days after discovery of the breach.
